Researchers with Allstate Foundation have teamed up with the National Safety Council to launch a program called Drive It Home, aimed specifically at parents of newly-licensed or soon-to-be licensed drivers. The idea is to not only educate parents about the potential dangers new drivers face, but also to provide tools for how to educate, establish guidelines and enforce rules.
The program uses a combination of graphic images and videos to drive home the message.
Researchers say that parents are the top source of information for teen drivers. They can lead by example and also by setting up clear expectations and consequences for failure to meet those expectations. Still, many parents are reluctant to take on this role. They perhaps have some poor behind-the-wheel habits themselves or don't feel qualified to teach road safety. They leave it up to the driving instructors.
But even with graduated driver's license programs, which are now in place in most states throughout the country, driving instructors are only going to have a limited amount of time with each pupil. It's up to you to ensure your teen is getting enough practice and that he knows what to do when encountering things like ice or aggressive drivers. He also needs to truly understand the potentially devastating and deadly consequences for things like speeding and driving while intoxicated.
It's a parent's job - or both parents' job - to underscore those points.
Some of the additional findings discovered by the Allstate Foundation's research include:
- Many parents simply don't understand how dangerous it is for their teenager behind the wheel. Inexperience is the top cause of crashes involving teenagers. And yet, three-fourths of parents think that the leading cause is unnecessary risk taking. That may lead parents to assume that because their child isn't a risk taker, he doesn't need additional guidance. But that's not he case.
- Although 90 percent of parents say it's critical for teenagers to learn how to drive at night and with other passengers, one-third of parents concede they haven't gone over these skills thoroughly with their child. In the end, this does a new driver a great disservice.
- About a third of parents of new drivers don't set any rules at all with regard to the teen's access or use of a vehicle. In fact, many aren't requiring their child to get permission before taking the vehicle somewhere. This leads to a perception that driving is a right, rather than a privilege. This kind of thinking can lead to more careless behavior.
Some things you can work on specifically with your teen include:
- Carefully watching the road ahead and learning to recognize certain hazards and how to react to them;
- Being mindful to control speed, turning, stopping and following distance;
- Becoming more skilled in judging the gap between vehicles in traffic;
- Managing high risk situation, such as driving at night and with passengers.

Driver Distractions in New Mexico Car Accidents

If driver distraction played a key role in the accident, it is very important for an injury victim to investigate the incident and determine which type of driver distraction caused the auto accident.
Being involved in a car crash is never an ideal situation that a person would like to be in. Unfortunately, many people will be involved in at least one motor vehicle collision over their entire lifetime. If you were injured in a crash, it is very important for you to evaluate the situation and determine what may have caused this serious collision. Whether the accident was a side-impact crash (T-Bone collision), a head-on accident, or a rear-end collision, determining whether a distracted driver was the cause of the accident can be the source to financial recovery.

Visual Distractions: These disruptions in driving can be extremely dangerous because they involve taking your eyes off of the wheel. Whether you are reading a text message or looking in a mirror, this action is very dangerous. The U.S. DOT estimates that taking the eyes off of the wheel for 4.6 seconds at 55 mph is the equivalent of driving an entire football field with a blindfold on. Other forms of visual distraction can include watching a video, looking at passengers, or even looking at a nearby traffic collision while continuing motion.
Cognitive Distractions: This is one that involves taking your mind away from what you are currently doing. When a driver falls asleep at the wheel, day dreams, or even drives while intoxicated, he or she is engaging in a cognitive distraction. Texting or talking on the phone can constitute a cognitive disturbance during driving because a person must devote attention to the message being sent.
The U.S. DOT predicts that a person is 23 times more likely to be involved in a collision if they are driving while texting. Although 35 states have prohibited the use of text messaging while driving, many people are still doing so and causing serious collisions as a result. Because texting and driving is considered to be a manual, visual and cognitive distraction, it is one of the most dangerous and lethal types of driving impairments in the country.

What is Wrongful Death?
A wrongful death lawsuit is filed by a New Mexico wrongful death attorney against a person or people who have caused the death of another person. The death may have been premeditated or resulted from careless, irresponsible or negligent behavior. - They provide assistance to a spouse, children or elderly parents who were financially dependent on the person that died. Albuquerque, New Mexico Insurance Companies Unfair Evaluation of Claims
Time for insurance adjusters to be fair in evaluation of personal injury claims.

Ever since the financial collapse of 2008, insurance companies have become stingier and stingier on the amount of settlement that are being offered on personal injury claims. Insurance adjusters claim that they "just don't have as much money as they used to" as the reason for this failure to pay the full value of claims.
The question I want to discuss today is, What is the fair evaluation of a personal injury claim with soft tissue injuries. Let's say that you are involved in an accident with significant property damage to your vehicle. You don't have a prior history of back or neck problems. You are taken by ambulance to the emergency room, examined, given x-rays and prescription drugs, told that you have a neck/back strain injury and sent home. A few days later you go to a chiropracter and treat for a few months. You don't miss any work. You feel great when released by the doctor. Let's also assume that your medical bills are at about $8,000.00
Given these limited facts, I would value the case at about $24,000 but most insurance companies would offer you $12,000--less than half the amount of my value. Am I wrong in my valuation, or is the insurance company wrong?
I believe the only way to determine the true value of the case is to base the value on prior experience. I routinely take cases to trial and arbitration. I can say definitively that this case would result in an award of about $24,000 I have done this time after time with the same result. CASES ARE STILL WORTH THREE TIMES THE MEDICAL BILLS if you have clear liability, significant property damage, good medical care of soft tissue injuries (whiplash, etc).
As lawyers, we cannot accept amounts less than the real value of the case, and we must be willing to litigate cases to get our clients the amount that our clients deserve--the true value of the case.

Are Texas Judgments Bigger?

Was it by happenstance or design that Texas was the setting for the first jury trial against the makers of painkiller Vioxx, a trial that ended earlier this month with a $253 million judgment against pharmaceutical giant Merck?
We're told the award likely will be reduced, but even then it would stand at tens of millions of dollars should the case survive on appeal.
It raises a second question: Might the huge award affect an entirely different set of drug liability cases nearing trial or under settlement negotiation in New Mexico and elsewhere?
The Vioxx award was to the widow of a 59-year-old Angleton man who had taken Vioxx for eight months and died after a heart attack.
For a while now, Texas has been among states widely considered to be generous toward plaintiffs in civil suits.
"Bunk!" replied researcher Stephen Daniels while working for the American Bar Foundation. Daniels' work was reported on by the magazine Texas Lawyer.
"Everything is thought to be bigger in Texas," the magazine reported, and people across the country have come to relate Texas with "mega verdicts." The article acknowledged that jurors in some counties, like Jefferson and Matagorda, have been quite generous. But mostly Texas jurors have been stingy, it asserted.
Daniels concluded that "swashbuckling" lawyers and others had convinced Texas lawmakers that jurors there are out of control.
Maybe so. Still, big product liability cases have a way of showing up early in Texas courts. In 2003, A Brownsville jury awarded an $18 million judgment after finding that the Ford F-150 Super Cab had a defective roof structure. A Laredo jury in 2004 awarded $9.4 million after saying Sears, Roebuck & Co. was guilty of malice in a tire service case. Earlier this year, a Zavala County jury found the 2000 Ford Explorer to be defective and awarded $31 million.
Mississippi jurors have a similar reputation for generosity.
Substantial jury awards can spur companies to settle other related suits without trial, whereas lawsuits that are rejected outright or lead to only small jury awards tend to get remaining plaintiffs to think twice about the rigors of court.
Diet drugs Fen-Phen and Redux were much in the news only a few years ago after a study by the Mayo Clinic linked the drugs to potentially fatal heart-valve damage. The drugs were recalled and thousands of lawsuits were filed across the country.
In 1998, one of the first cases went to trial in Texas, where a jury awarded the plaintiff $23.4 million.
Mississippi got another one of the early cases. That one ended in 1999 with $150 million awarded to five women.
Seeing substantial judgments going against it early, the drug manufacturer now known as Wyeth Pharmaceuticals offered $3.75 billion to settle a nationwide class action lawsuit. Many took the offer; many did not and continued pressing for their day in court.
New Mexico was to be another early battleground against the diet drug maker. But settlements and a 2003 defeat in a Santa Fe district court sent high-profile publicity elsewhere.
Lawyer Mark Caruso was among those representing Albuquerque resident Josie Garcia in that case. "We confused the jury because we sued for every cause of action under the sun," said Caruso, who remains one of the busiest New Mexico lawyers in the diet drug cases. "All we have to do under New Mexico law is compare the risks of the drug to the benefit of the drug."
Garcia is appealing her case and is among plaintiffs nationwide involved in an ongoing settlement negotiation.
Caruso since has had two diet drug cases settled in Rio Arriba County for amounts that remain sealed. The cases were settled after having already gone to trial. Caruso has three multi-plaintiff lawsuits scheduled in Santa Fe during coming months, the first to begin in November. He has two more in Tierra Amarilla and one in Grants.
Vioxx cases will keep New Mexico lawyers busy, too. Caruso said he has 15 Vioxx cases that he considers to be strong from among about 250 inquiries received by his office since concerns about the drug first became known.
"It's good to see a big win come off the block," he said of the Texas case. But he said he's not aware of any grand design by lawyers to try to use Texas for boosting chances of other cases involving Vioxx.
"The first big breast implant case in the country was based in Texas. The first Vioxx case was in Texas. ... But I think in Texas, it just depends which county you file in."
Will the Texas Vioxx award affect how lawyers approach unrelated diet drug cases?
No, says Doug Petkus, a Wyeth Pharmaceuticals spokesman. "We want to resolve cases but we will try cases when we think it's appropriate," he said.
Caruso said he had urged clients even before the Vioxx judgment not to move toward settlements hastily.
